SPEED “NASCAR SPRINT ALL-STAR RACE WATCH & WIN” SWEEPSTAKES
OFFICIAL RULESNO PURCHASE NECESSARY
SWEEPSTAKES PERIOD: Speed Channel, Inc. “NASCAR Sprint All-Star Race Watch & Win” Sweepstakes (the “Sweepstakes”) begins on May 17, 2008 at 6:00 p.m. Eastern Time (“ET”) and ends on May 17, 2008 at 11:59 p.m. ET (the "Sweepstakes Period"). By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Speed Channel, Inc., 9711 Southern Pine Boulevard, Charlotte, NC 28273 (“Sponsor”), which shall be final and binding in all respects.SWEEPSTAKES DESCRIPTION: Watch the live telecast (the “Telecast”) of the NASCAR Sprint All-Star Race™ (the “Race”),” (check local listings for exact times of airing in your location) to play. The Race is a 100-lap Race with a format which consists of 25-lap segments (each a “Segment”). There will be a total of four (4) Segments during the Race. During the Telecast, an announcer will ask two (2) questions to which a list of multiple choice answers will be provided. The first question will be provided during the Sprint Showdown Race™ which takes place during the first Segment. The second question will be provided during the NASCAR Sprint All-Star Race™ which takes place during the second or third Segment. The questions may also be viewed online at www.speedtv.com. Each entrant who answers a respective Segment Question (a “Segment Question”) correctly during the allotted time for that Segment, will then qualify for that Segment’s random drawing to be named a Segment Prize Winner (each a “Segment Prize Winner”). Additionally, each entrant who answers both Segment Questions correctly will be automatically entered into the random drawing to be named the Grand Prize Winner (the “Grand Prize Winner”). All entries must be received electronically by the end of the Sweepstakes Period to be eligible. The Sponsor’s database computer is the official time-keeping device for this Sweepstakes.
ELIGIBILITY: Only legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry are eligible to enter. Void in Puerto Rico, Guam and the US Virgin Islands and where prohibited by law. Employees of Speed Channel, Inc. (the “Sponsor”), National Association for Stock Car Auto Racing, Inc. (“NASCAR”), Sprint Communications Company, LP and their respective subsidiaries, parents, divisions, affiliates and related companies, and each of their respective shareholders, officers, directors, members, and agents (collectively, the “Released Parties”) and immediate family members and/or those living in the same household of such employees, are not eligible. All federal, state and local laws and regulations apply.
HOW TO ENTER: No purchase necessary to enter or win. A cell phone with text message capability or a computer with Internet access is required to participate in the Sweepstakes. There are two (2) ways to submit an answer and to be automatically entered: (1) By Mobile Phone Text Messaging: Send a text message to SPEED3 (773333) with the numbers 1, 2, 3 or 4, your answer to the respective Segment Question. Please be aware that your standard mobile phone text messaging fees will apply and will be charged to your account. (2) For Free Alternate Means of Entry Via the Internet: Visit www.speedtv.com and follow the online instructions to submit your answer.
The Released Parties are not responsible for lost, late, damaged, misdirected, illegible, or incomplete entries. Incomplete entries are ineligible. Unclaimed prizes will remain unawarded. Forged entries, altered entries or entries obtained other than as set out in these rules will be void and ineligible. Entry must be made by the entrant, only in the manners as set forth herein. Entries made by any other individual or any entity and/or originating at any other Internet website or e-mail address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared void and as such deemed ineligible for this Sweepstakes.Sponsor may prohibit an entrant from participating in the Sweepstakes if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor’s representatives, or if entrant has or had attempted to submit malicious code, .exe files, or any file that contains malicious code.
There is no limit to the number of times you may attempt to answer the question correctly. Limit one (1) entry with the correct answer per person and/or e-mail address per drawing. Only entries with correct answers will be entered into each prize drawing and only entries with two (2) correct answers to each Segment will be entered into the grand prize drawing.All entries must be received by the end of the Sweepstakes Period in order to participate.
DRAWING AND WINNER NOTIFICATION: The winner of the Sweepstakes drawing will be randomly selected from all eligible entries received throughout the Sweepstakes Period. The random drawing will take place on or about May 22, 2008 and will be conducted by Sponsor or its designee using randomization methods selected in its sole discretion. The potential winner will be notified by telephone and/or mail and/or email using the contact information given at the time of entry. No responsibility is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, the potential winner does not respond within ten (10) days of the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines the prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Prize will be awarded.
PRIZE AND ODDS: One (1) Grand Prize is available. The Grand Prize consists of a trip for two (2) Concord, North Carolina to attend the 2009 NASCAR Sprint All-Star Race™. The trip includes round-trip coach class air transportation for winner and a guest from the major commercial airport nearest the winner’s primary residence to Charlotte Douglas International Airport; luxury motor coach accommodations for four (4) days/three (3) nights; ground transportation in Concord, North Carolina; admission for two (2) to the 2009 NASCAR Craftsman Truck Series™ race which takes place in conjunction with the 2009 NASCAR Sprint All-Star Race™, admission for two (2) to the 2009 NASCAR Sprint All-Star Challenge™ and admission for two (2) to the 2009 NASCAR Sprint Pit Crew Challenge™; Two Hundred Fifty Dollars ($250.00) spending cash for the Grand Prize winner only and one (1) Speed/NASCAR®-officially licensed “Welcome Package”; Grand Prize Winner and guest must be able to travel to Concord, North Carolina on May 14, 2009 through May 17, 2009. No alternate travel dates available. Winners not able to travel on those dates will forfeit prize package and an alternate Grand Prize Winner will be selected in a random drawing from among all eligible entries received. Guest must be 18 or older or if guest is a minor, the Grand Prize Winner must be the parent or legal guardian of the minor. All minors must be accompanied, at all times on trip, by an adult. Actual value may vary based on initial point of departure. Sponsor reserves the right to change all travel dates. Winner and guest must travel on the same itinerary. The Approximate Retail Value (“ARV”) of the Grand Prize is Five Thousand Four Hundred Fifty Dollars ($5,450.00).
Two (2) Segment Prizes are available. Each Segment Prize Winner will receive one (1) MOTORAZR2 V9m by Motorola phone with one (1) year (12 months) of Service (the “Service”), as more fully set forth below. The total ARV of all Segment Prizes is Three Thousand Two Hundred Sixty Dollars ($3,260.00).
The total ARV of all prizes combined is Eight Thousand Seven Hundred Ten Dollars ($8,710.00).
The Service includes unlimited nationwide Web surfing, text, picture and video messaging, GPS navigation, exclusive NASCAR® content, as available, plus Sprint TVSM, over 150 radio stations and channels, and access to the Sprint Music Store. Premium content/downloads (games, ringers, songs, etc.) are an additional charge. Texts to third parties to participate in Sweepstakes or other may result in additional charges. International services not included. Sprint Music includes 150 radio channels and access to $0.99 song downloads. Sprint TV includes over 20 available channels. GPS Navigation includes Sprint Navigation or TeleNav GPS Navigator. GPS reliability varies by environment. E-mail includes use of ActiveSync, Microsoft Windows Mobile with Direct Push™, VersaMail, IBM Lotus Notes Traveler® or BlackBerry Internet Services (BIS). Offer and service plan features not available in all markets/retail locations or for all phones/networks. Services are not available for use as a modem, in connection with server devices or host computer applications, other systems that drive continuous heavy traffic or data sessions, or as a substitute for frame relay connections. Coverage not available everywhere. Model and model amenities are subject to availability. Any additional charges or features not described herein as being awarded, including but not limited to airtime/minutes, taxes and any other charges incurred on your monthly cellular phone bill are the responsibility of the winner. If any prize or portion of a prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded. Odds of winning depend on the number of eligible entries received.
GENERAL PRIZE CONDITIONS. The prize winner shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the prize. The potential winner and guest will be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). If a winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either will be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner will be required to ratify and sign Prize Claim Documents. If a winner (or, in the case of a minor, such minor winner’s parent or legal guardian) fails or refuses to sign and return all Prize Claim Documents within ten (10) days of prize notification, the winner may be disqualified and an alternate winner may be selected.
GENERAL LIABILITY RELEASE/FORCE MAJEURE: Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. Entrants (and any minor entrant’s parent or legal guardian) agree that the Released Parties (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. Sponsor assumes no responsibility for any damage to an entrant’s computer system which is occasioned by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, the Released Parties are not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted. In the event of a dispute as to the identity of the entrant, any on-line entry will be deemed submitted by the authorized account holder of the e-mail account from which it was sent, provided such account holder must still meet the eligibility requirements for the Sweepstakes. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the entry will be deemed ineligible. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes or the Sweepstakes drawing is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes or the Sweepstakes drawing as contemplated herein. In the event Sponsor is prevented from awarding prizes or continuing with the Sweepstakes or the Sweepstakes drawing as contemplated herein by any event beyond its control, including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis (e.g. SARS), order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), then subject to any governmental approval which may be required, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes in its entirety or the affected Sweepstakes. If the Promotion or the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select the winner in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
